can you refuse to work over 40 hours if you are being made to

I don't think it's limit to a state. It's a national thing to have a 40 hour work week, although that's not set in stone. You can work parttime.

If your employer tells you to work over 40 hours, he'd have to pay you time and a half for those extra hours. But if you refuse to work the extra hours, he can and very likely will fire you.
