The house my mother owns has an apartment above it, and she is renting to myself and my boyfriend. Since we had a spare room, we figured we'd let his friend who was in a tough situation move in to get back on his feet, he is not on the lease, he has not paid rent, and he does not have a job. Everything has fallen apart, is it legally okay for us to just tell him to leave, he has other places he can stay, and we refuse to put up with him any longer.

Sorry if this seems like a silly question, I'd rather do everything properly and this being the first apartment I've ever rented and it being rented from my mom, I'd rather ask then do something wrong.

Also, this isn't just a random guy living with us, this was at one point my boyfriends best friend which is making matters worse.

i had that problem 3 times. he is not on your lease so it is 100% legal for you to tell him to pack his stuff and leave at any point in time. beware though when you kick him out change your locks on your door because he might try to come back and do something very stupid. just sit him down with your boyfriend and tell him you guys are no longer comfortable with him living with you. you gave him enough time and he didnt get his things in order so its time for him to go now. thats your best bet.

You have NO obligation, legal or otherwise, to continue to provide a rent free place for the friend. To do so would only continue to foster his dependence and your resentment. I would suggest you set a date for him to be out and let him know that if he is not out, you will place his belongings out in the street. It is important that you FOLLOW THROUGH with this and that your bf support the decision to give him the boot. If there is any wavering on either of your parts, the friend gets to keep on doing what he's doing, which is NOTHING!! I feel bad for him, too, HOWEVER, I could not allow this situation to go on in my home either....it would make me crazy. Finally, when it seemed like he was at the end of his rope, he found ya'll, right? He can find another place to live AND get a job to support himself. You dont owe him anything. Give him the respect and dignity to learn he can take care of himself.

If he did not sign anything then yes, you can tell him to leave. You are only enabling him by letting him stay there rent free with no job. He needs to learn that the real world does not work like that.

Ask him to leave nicely, if he still doesnt go, get his things, pack them and put them at the front door. Hes not on the the lease and has no legal right to be there if you dont want him there. If all else fails ring the cops and they will ask him to leave.

Depending on where you live, and how long he's been there, there might be laws saying you have to give him a certain amount of notice.

have your boyfriend tell him to kick rocks, beat it or what ever, you have every right he has non legally ..go for it...be nice..
