For the past 4 years we had issues with him coming home when he feels like it, he was also caught sending inappropiate text messages to other women. Not to mention all the other mess that I dealt with. Now that I am finally fed up and trying to move on with my life; he says he's not going to sign the documents because he deserves another chance. The only chance he'll get is to mend the relationship with the children for never being there for them. I'm not giving him another chance to hurt my feelings, I just want to end the marriage and move on. But he won't sign the documents.

Both parties have to have notice of the proceeding. If one does not answer or appear, it can proceed without him or her.

No you don't even need sep papers but you might get a restraining order... And if he shows up call the police...Oh and you can tell numb nuts that he dose not have to sign anything...You can do the divorce with out him...The courts will grant it.......Get a lawyer...ASAP...Good luck

Take him to Family Court and ask for alimony. They will make him sign or you will be legally divorce in six months.
