We wouldn't need a Supreme Court or even a Constitution.

Then the only check on unfettered government abuse would be the ballot box.

And in a country where over 70% of those who bother to vote (which is often less than half the eligible population to start with) admit that they simply vote the party line without even looking at the issues, that's no check at all.
