Yes. And even if she doesn't. if it was illegal your mother's approval would not legalize the act, it would only make her a criminal as well.
Green_Conservative - To clear things up for you, when someone is over the age of consent they can legally consent to sex with anyone. A person having consensual sexual relations with a person over the age of consent CAN NOT be charged with having sex with a minor. That is what the age of consent is all about.
Troop28leader - If something is a crime, it is a crime regardless if it is reported or not. Your answer implies that someone in this relationship is committing a crime, however that is not the case in this situation. You should read the law before answering law questions. I did.

if the age of consent is 16 and you are 16 or older it doesnt matter if your parents approve the state says you are old enough to make the right decision about sex. so that means you can be 16 and have sex with a 50 year old if you really wanted to and your mom cant do anything about it except maybe ground you

The laws in your state state that if you are age 16 years or older you may have sex with someone older than you, provided they are not in a position of authority(i.e. school principle, employer). However, it is possible if your parents do not approve of your relationship, they can take out a restraining order against your boyfriend until you turn 18.
