We put a deposit on an apartment in the begining of october. When we moved in the same night we moved out, because it was infested with roaches. And he now will not give us the deposit back because he does not want to lose out in a months rent!! Are we intitled to the deposit if it was infested?? He did not have a lease agreement. Anybody with good advice please help!! Thanks!!

The landlord is within his rights. When you moved in, you took possession and are a month-to-month tenant. According to the law, you need to give him thirty days advance notice of your intent to vacate. I'd venture he took your moving out as a sign that you gave such notice. He's entitled to the October rent.
