She may be deliberately trying to hurt the baby to get back at him. I know it's tearing you all apart, but it's her body and no one can "make" her do anything. If she were doing illegal drugs, that would be another matter. She is taking a lot of health risks with her baby, but clearly she isn't concerned. There is a much higher risk of her developing high blood pressure, of having a low birth-weight baby, and a baby who can develop respiratory problems later in life. But I've also been working in OB long enough to see how amazing and resilient babies are, and I've seen babies born strong and screaming when you would least expect it, God bless them.
If your brother seriously wants to fight her for custody, he had better tell her up front what his plans are. Maybe it will give her a wake-up call. Otherwise, he'd better talk to CPS and start collecting his support, because he will have one big fight on his hands. It's not easy to succeed in taking a baby away from it's mother. I know you must feel terrible about this. Even though your brother's girlfriend is really nasty and smokes way too much, your brother should get back together with his ex. For one, the main reason why your brother's girlfriend is smoking so much, is because most likely of depression of the breakup, or she's just given up on all hope, which theoretically, is depression. If your brother really wants to have a healthy baby, then the best way to go is to have a nice talk with his ex. If your brother and ex just give up, the possibilities of having a healthy baby is very small. Some babies can die from too much smoke inhalation, others have serious cases of asthma when born, and if your brother's ex drinks too, then I feel very sorry for that poor baby.

Unfortunately, its not illegal for a woman to smoke while she's pregnant ... but it doesn't mean with 100% certainty that the child will have problems either.
I don't know the situation, but if she doesn't have support from your brother or anyone else, its going to be harder for her to quit smoking. Pregnancy is a very stressful time -- the best time to stop smoking, but I've been told its very hard.
He needs to make sure that he goes with her to every doctor's appointment, and he needs to let her doctor know that she is still smoking so the doctor can be looking for complications that might arise because of it. Then, like another answerer said, this will be documented and if your brother decides to sue for custody, it will be taken into account.
Maybe your brother and parents could speak to her all at the same time, explain their concerns, and ask specifically what they can do to help her stay healthy and make her body a good environment for the baby. Regardless of what anyone thinks of her, she is carrying a member of the family and pregnancy can be hard, especially if she thinks she has no one to turn to.

Call the police?? What a joke you are!
Is she smoking crack? If not then NO judge or anyone will see her as an unfit mother.
They will however see your brother as a loser who can not deal with stress, he just leaves when the going gets tough! What is he going to do if your little fantasy world was to come true and he was to get custody of the baby? He would probably abandon it when it cried too much!
I hope she keeps the baby away from you and your crazy family!

There is no quit smoking medicine that she can be given that would not harm the baby even more than her smoking. IF she really cares about the baby then she would try to cut back. There is nothing legally you can do, it is Her child and HER BODY. And the "harm" is not proven.. Millions of women smoked while they were pregnant with no adverse side effects. You should tell him next time he should WAIT TILL HE IS MARRIED to KNOCK SOMEONE UP!!!

Unfortunately while she's pregnant there's nothing that can be done to make her stop smoking.
Just try to support your brother however you can and as soon as that baby is born make sure he establishes paternity and fights to have an equal part in raising that baby.
I know it's a tough spot, but just hang in there!

I don't know what you can do now, but make sure to document that she's smoking while preggo and then your brother can try to get full custody of the baby by showing she's not a fit parent.

i think if anything ur brother should be supporting this girl as much as he can right now...trying to help her stop smoking. After all this is his baby too. He shouldnt do it for but for his baby

You have absolutely no right to tell her to quit smoking.
No,it isn't the healthiest thing to do while pregnant,but it's her own business and NO ONE else's.
My mother smoked while pregnant with all of her children,and we were all fine.
Your "poor brother" just abandoned a woman that HE knocked up. Good for him,he seems like a GREAT guy.
Get over it,abandoning her won't make her stop.
Perhaps yall should help support her in adapting a healthy lifestyle rather than just turn your backs.

ok well first. theres nothing you can do about her smoking while pregnant , im sorry but its not against the law to do it , all you can do is tell her how its making him feel and hope she at least cuts back. now iam a smoker myself and iam carrying a baby boy and iam 25 weeks pregnant and smoking hasnt done nothing wrong to my baby at all. they say it does but i dont beleive it, now i was smoking 16 smokes a day before i was pregnant and once i found out i was pregnant my partner made me cut back to like 5 a day and so thats what iam doing. now ive told my doctor iam a smoker and does he want me to quit and he said no because it will stress the baby out becuase its addicted to the nicateen hits your giving it and if your not a smoker no more then the baby will have withdrawls. and pluss if your a smoker when your stressed you have a smoke right? well if you quit smoking while pregnant it does stress you and your baby out and can cause you to be put into hospital and things go wrong with your pregnancy. now i agree that she shouldnt be smoking that many a day and thats wrong, she should at least cut back for her and the baby and the father who is so worried. your brother should be happy to be a daddy and i know that sometimes you dont want to have a baby to someone like that, but sometimes it happens and theres not you can do. im sorry to hear whats going on and i hope she finally wakes up to herself and see's who shes hurting cause no one needs to go thro this at all , not even your brother.
