Notice To Pay Rent Or Quit

NOTICE TO: ALL TENANTS
TENANTS in possession and all others:

TAKE NOTICE, that you are hereby required to quit, and deliver up to the undersigned the possession of the premises now held and occupied by you, being the premises known as:

At the expiration of 5 days commencing on December 1, 2008 and Ending on December 6, 2008.

This Notice to Quit specifically terminates any oral/written agreement you may have with respect to the said premises at the date specified above.

1.Pursuant to an oral lease, you are obligated to pay certain rents on the premises described as: ADDRESS (the “Premises”), of which you now hold possession.
2.You are late in the payment of rents totaling $1,400. This rent was due on September, October, November and relates to September 2007- 50, October 2007-$450, November 2007-$450, December 2008 -$450
3. You are hereby required to PAY the said rents, in full, to the Landlord, or it’s agents, within 5 days after service of this notice.
THIS IS INTENDED as a 5-day notice to quit, for the purpose of terminating your tenancy aforesaid.

This is a notice I am going to serve... Do I serve it in person and mail it?

The first thing that I notice is that the date this notice is to commence is Decmber 1, 2008 not 2007.

This notice as it is written does not take effect for more than one year from now.

I also note that the September 2007 rent is listed as $50 not $450. Perhaps you were just short $50 that month? Also I note that as written he is charging you for December 2008 rent not 2007.

These are typographical errors that will slow him down and force him to post a new notice with the correct information.

I recommend that if this applies to you that you contact an attorney who specializes in landlord tenant law.

Also, if this applies to you I recommend that you contact your landlord and explain why you are having trouble paying your rent. If it is short time, such a s job loss your landlord may be willing to work with you.

I know I have been a landlord for 40 years. People have troubles occasionally. In my experience if a tenant was willing to be honest with me and figure out a way to get caught up on the rent, I was generally willing to work with them.

Looks good to me, except that you MIGHT want to change "At the expiration of 5 days commencing on December 1, 2008 and Ending on December 6, 2008." to reflect this year, unless you want to evict them NEXT year at this time.
