I live in Ohio, and am 21. I work almost full-time at 38 hours a week, and I worked an 8 hour shift yesterday that ended at 1am this morning, and I'm supposed to go to a manager meeting at 7 this morning. according to the law, should i get paid overtime? is it based on law (and if so which) or is it based on company policy? please help! i can't find the answer anywhere! :(

This can vary from one company policy to another. Some say you get OT if you work more than 40 hours per week. Some say you get OT if you work more than 8 hours a day. However, I think the Labor Law states you have to have at least 8 hours between shifts, I think. But since this is just a meeting and not an on-going thing perhaps it's not worth making a stink.

UPDATE:
OK. I did some research. This is how the law reads for Ohio:

"Overtime" shall be paid at one and one-half the employee's wage rate for hours worked over 40 in a pre-established work week, consisting of not more than seven consecutive days.

"Pay Period" employees are entitled to wages no less than on or before the 15th and 30th of each month.

Minimum Wage Rate

All Employers: Non-tipped employees $6.85; tipped employees $3.43

Overtime

All Employers over $150,000.00 will pay overtime at one and one-half
the employee's
hourly rate after 40 actual working hours


Employers who gross less than $150,000.00
no overtime required for hours over 40

Nope. You're not working more than 8 hours within the day.....and I believe in most states your employer doesn't actually have to pay overtime until you work over 40 hours a week.

You are only required to be paid overtime if you work more than 40 hours in one week.

Overtime is paid by hours worked total. It doesnt matter how much time is in between shifts.
