I want to file for divorce. As a matter of fact, I paid the filing fees and I have a form to mail to her so she can sign it and send it back to me. The only problem is I have no idea where she lives or what her phone number is. Is there anything else I can do? I already spent $374 filing fees. I don't want to hire a private investigator or spend anymore money than I have to. Can I tell the court that she abandoned the marriage?

How about "mutual friends" ? Normally they "dissapear too" but there must be someone who still keeps in touch with her !

Everything depends on the law of your State.

Every State is different.

In some States .. if you cannot locate your wife for divorce - you can put an announcement in the newspaper (it's done all the time in my State) .. and in some cases the notice can be posted in the Court House. Also - in some State - there are certain advantages to divorces due to abandonment.

That's a rough one. I'm pretty sure there are ways to get divorced if you don't know where the person is. However, I have no idea how to do that. Don't you know anyone she knows? family? friends? Try running a search on line, like intellius.com. For a small fee you might be able to track her down that way!

Talk to your attorney about divorcing on grounds of abandonment and/or desertion. As long as it's been a year, in most states, you shouldn't have any problems getting a divorce granted.

Talk with the courts where you paid the filing fees first. But, you should be able to post/advertise the upcoming filing in the local newspaper for up to 30 days and if there is no response then the divorce slides through the courts. If she does respond, then you go from there.

Make it a Pulbic notice. Go the the newspaper in the county/citiy that you believe she may reside in and have them print it in their Public Notification column. If she doesn't respond within the 30 days given, take the receipt you receive from the newspaer and filing the Default documents. The Judgement docs. follow. Enjoy your new life.
