You operated a motor vehicle in the state of California while your blood alcohol level exceeded the legal limit. Just barely is meaningless here. You can be charged with DUI if you are under the limit if your operation is impaired. At or over the limit you are considered impaired regardless of how polite and cooperative you were.

The federal laws will not help you here, you are subject to the California laws.

You really should hire a lawyer. There are a lot of possibilities with DUI and no two cases are the same. If you try to excuse your behavior ("I was barely over the limit", "I did not drive there, I just moved the truck) the judge will be harder on you.

Get a lawyer... .09 is over the limit... $1750 fine, $100 in court costs, 6 month MAAC Project, 3 to 5 year probation and your car Ins will go up... A lawyer will help smooth the progress through the system... Start MAAC now, it looks good to the court if you jump on that right away... Good luck...
