I was side swipped yesterday afternoon and my car is totaled. I was backing out of a church parking lot and was going into the center lane of the street. And that's when he hit the rt. back side of my car. The bad thing about this is my son was inches from being hit. He came out with eight stitches on his face and glass in his head. Thank god he's going to be okay but I got a ticket for improper backing. That was the only way out of this parking lot. Ive seen people do it time and time again there so I dont understand why I got the ticket. The guy was going to fast and couldnt slow down. It was raining out so I tried to brake but couldnt. I have court the 28th of Dec. and Im furious. Any suggestions would be helpful.

I'm sorry about your son, but just because you've seen it happen doesn't make it legal. You can try and fight the ticket, but if it's illegal, you won't win. And was he speeding or just going too fast to stop in time? There's a big difference between the two, and you'll have a very difficult time proving the former.

Cars running along the street has the "Right of Way" than cars coming out of an intersection or parking area. Thats why corner street carries a YIELD sign. Its your fault and just pay the fine. and consider yourself lucky that you are still alive.

Pay the ticket and be more careful next time.
If you backed out into traffic ad were hit, its YOUR fault.
