A Topeka man is fighting a legal battle over parental rights, because his babies' mother says he is just the sperm donor.

Hendrix is a gay man who didn't think he would ever become a father. Then in 2004, the Topeka resident said a longtime female friend named Samantha Harrington approached him and asked if he would father a baby for her through artificial
insemination.

So Hendrix said he agreed to the deal. "I thought everything was perfect and I said, 'Do we need anything in writing?" he said. "She said, 'Daryl, we've been friends for 10 years. I'm an attorney. Kansas is an oral agreement state. There will be no problem.' And I took her word for it."

Hendrix said when he went to the hospital to see the infants, a boy and a girl, he was turned away.

The next day, Harrington filed legal documents asking that Hendrix have no parental rights. Hendrix too went to court.

Yes he should be given access to his children. Women like this are as bad as fathers that don't want to play a part in there children's lives. Both damage the children. She is not thinking about her children at all, selfishly putting what she wants above and beyond the needs of her children. Children have a right to a relationship with both parents, and as he clearly wants to be involved, she is very wrong to try and keep him away. It takes a man and women to make a child, and they should both have equal rights when it comes to having a relationship with them.

I hope he not only wins his case, but successfully files with the Kansas Bar to revoke her law license based on unethical conduct.

From this article, I cannot tell what she led him to believe or what their oral agreement was so it's hard to say. It does sound as though she abused her position as an attorney on this one. I think he's got a good case.
