My sister has a 7 year old and the father has been out of the home 5 years. He has never paid support but has just bought a brand new truck, makes good money...
She works full time, but by the time she pays all bills and child care while she is working, she doesn't have money to pay the childs health insurance or other things.

Yes, he does get weekly visitations.

In a New York minute. A man who doesn't help support his children is scum. He needs to be taken to court and made to pay.

What a question!
Well, I believe that the father being in the child's life is most important aspect. But, at the same time, he has a responsibility to help out financially.
Since it took two to tango, then the mother should attempt to settle the financial dispute between them without involving the courts first.
If that doesn't work out then yes, she should take the legal route. But, of course during the processes, she should never deny the father visitation rights. That hurts only one person, the child.

First of all this is not relationship;s..But since..you are here...and kind of lost..Let me HELP you out.

By law he has to pay child support and she doe's not need to hire a laywer ..she can contact a local social serivces attnorney and they will deal with him..and without having consent they "Automatically"

take "his" Child support from him...Without seeing his face.
I did that with my baby gurls daddy..yeah he was not happy..But kid's are not cheap..and If two can make a baby than they have to be "Responsible" to clean up there own mess.

No if's or but's..Tell ur sister..to see a state local and she should not pay a dime..For such.I did that since..I could NOT afford a lawyer ...and if you can..there are not CHEAP$100hr//and that does not include paper work and tracking his infromation..the GOVERMENT doe's better..

I applied for my child support in August and I got payment's by October..and every month since.

Good luck..and Hope those kids get insured even if you get medicade..

Guys like him really piss me off! I payed C.S. for over 16 years. I even payed through the summer months when I had custody of my daughter even though it was in my court order I didn't have to pay. I stayed current all through the years But we ate a whole lot of Macaroni and beans to stay that way, I'll tell ya! When she turned 18 the state said I didn't have to pay any longer and I did anyway since she was only halfway through her senior year of High School. I am now paying her entire college tuition. I also have three other kids to pay for, but I'd do it gladly and more for all my kids. Take his AZZ to court and make him provide a better life for His Child! With the state in your corner, he won't be able to keep "Weaseling" out of it. Call your States child services division TODAY!!!

The child is suffering. The child could benefit from the support.Tell her the support is for the child.With that money she can give the child better thing that it needs.

She should have taken court action immediately five years ago. If the guy wants to visit with the child he should pay for it.

this would be for the best benefit of the child
as the child is too young to protect own interest, the mother must act on her behalf

He should be helping to support his child. Yes, he should be taken to court.
She should also include a portion of daycare, insurance and school expenses, and a clause for future education such as college.

Tell her to go up to the local child suppport agency and file for child support....
she doesn't have to hire a lawyer or anything like that!
