Once she has married he has no obligation to her.....Depending on the state...

If by maintainence you mean money paid directly to her for her (not child support), then in most cases that stops when she remarries. If he owes her back alimony, he won't be able to get out of that because that is money he owes her, just like if he were to get behind on child support, when the kids are finally grown, he would still have to pay the child support that he missed.

Now if you are talking about child support, then no. The only way he gets out of that is for the kids to reach 18 or 21 depending on what his divorce decree says.

This is something that he needs to review with his lawyer.

Something for you to watch for, sometimes men in his situation lie to their new SO's about what exactly they are paying their exwives because they don't want to scare off the new friend. Make sure you have all of your facts before you get sucked into a situation you don't want to be in.

Good Luck.

Depends on what your divorce decree states. In most cases, once the former spouse remarries alimony ceases. However, that does not include child support. Child support still must be paid.

Depends on what the divorce papers say but even if it says he continues to pay alimony, he needs to go back to court and get that ruling changed and show just cause by her getting married again. She now has another who can care for her so her ex shouldn't have to.

He needs to read his divorce decree first - does it say maintenance stops if she remarries? It should say in there if there is any case where maintenance would stop. If it doesn't say, then it probably continues for the rest of her life. If it's not clear after reading the divorce decree, ask an attorney.

He needs to check with his lawyer...but I would imagine that once she remarries...his obligation to pay maintenance should stop....

If there are no children from his first marriage then no, he should not have to continue paying her. He would hae to continue paying for any children he had with her that's all.
