When I was just a boy, my father built a brick workshop in his garden. I have no idea if he applied for planning permission or indeed if he needed to. I was told by a friend there is a time limit on planning regulations and if the structure had been in place for 10 years or more without complaint, it was legally allowed to stand in situ. Is this TRUE? If it is not, do I have to take it down, or can I apply for a backdated planning permission, even though the work was carried out years ago?

Every locale is different. You will need to do some research on your local planning regulations. The public library can help you search. Usually the planning department will not search and destroy illegal buildings unless you are planning to have other work done on the property, you are planning to sell the property (and must disclose the unpermitted unit), or it is some kind of eyesore or hazard that is reported by a neighbor. If you are just living there quietly, it won't be a problem.

You could google maps and look at your house, if the construction is on the map it could be legal.
I would hesitate to bring it to the attention of the powers that be, in case they tell you to pull it down.
Small structures less than one third the size of the main house and more than 25 meters from the road do not require planning permision.

if its over 10 years and u can prove then its fine .. otherwise apply for retrospective planning permission.. you can check if he had permission by goin 2 council planning dept ask to see the copy of plans of your area this shows all planning apps ever made look to your house see if there is a planning number written on it .. if so there will be a record prob onm micro fiche u can look up & copy

If it was legally built, it can legally stay. If it was built without a permit and one was required, it is, and will always be, in violation.

i think you'll find that its safe to remain ..ring your local planning department (don't tell them who you are ..Mr smith )...they will tell you more accurately than us old builders
