My former employer did not like me because of my ethinic background. It was not the person that hired me, the company switched hands. I was fired for something, that according to the company handbook should have been a written warning. Other employees violated the same rule and nothing happened to them. I know NYS is an at will state, but I want to know if I could pursue this legally.

If you can PROVE that it was your ethnic background that proximately caused your termination then you may have a case. This may be difficult especially as a rules violation was involved and you admit to that fact. It would be easy enough for the employer to rebut your claim of ethnic bias by pointing out that your violation of the rules was so egregious that a mere written warning was not sufficient in your case.

You haven't provided details of what the specific violation was and more importantly you probably don't have factual knowledge of all of the details of the alleged violations by other employees and what actions were taken against them. Just because someone says that nothing happened doesn't make it so. They may have even taken a demotion or pay cut but are unwilling to share that tidbit of information with you.

You need to consult with an attorney who specializes in labor relations and employment law. They can provide you with legal advice and help you decide if you have a case worth pursuing.

Unless you can validate your complaint that you were terminated on race/ethnicity grounds, then you probably don't have a strong case.

You will have to present solid evidence that this was the grounds for your termination, and that is often difficult to do. Any comments made about race/ethnicity? Any e-mails. Any witnesses? Is there a pattern of this (meaning more than just YOU). If you were the only one let go, the case is probably weak. If there appears to be a "pruning" of a certain race/ethnicity from the employment pool...it may be something that can be looked into.

The big problem is that you appear to admit that you did commit some wrong-doing, so it was not a completely race-based termination.
