I have a court order in effect but I am still owed 30,000 atleast. State agencies are not too aggressive. Does anyone know how to get involved with the sheriff joe roundup for dead beat dads?

He hasnt filed taxes in years. Typically works under the table.I just found out where he lives. I want him put in jail. State agencies have not been aggressive .

I am in Arizona. All of your ideas are great but he has no real estate. Nothing in his name. Not married etc. As far as "the scare" He is 6'5" 240 and is scarier than any mole I know. lol That's why I am so frustrated! Keep the advice coming I appreciate any input.

It's a little difficult without knowing your state, but in my state, you can get all the forms you need from the pro se clinic at your local court and you can get them on line at the judicial website, so check there. Taking it to court without an attorney is a snap. You have a court order for him to pay. He hasn't paid. You put that in the pleadings you file with the court and the burden shifts to him to prove payment. He won't be able to prove payment and you win. Next-collecting the judgment. More paperwork, but not difficult. You garnish his paycheck if he's working; you garnish his bank accounts; you garnish his tax returns; and you get a Writ of Execution to take his property. These are all fill-in-the-blank forms in my state. Also, you can turn the Judgment into the equivalent of a mortgage and even foreclose on his real estate if he has any. The sheriff does not get involved until you get the judgment and start the collection processes. Incidently, regarding the garnishment, you can take more of his paycheck for child support than the percentage allowed for other debts. Our state office is aggressive enough, but very overburdened and therefore, very slow.

I did this kind of work for nine years. Don't expect too much.

If there is a Bowen order out on him and the cops haven't picked him up, you have to be a pain in the *** to them. Call the police everyday.

Once he is arrested, he will end up paying some small amount of money and get released.

Then, when he misses another payment, you call the enforcement agent and bug them to get it set for court. Then yo get another Bowen, and do it all over again.

The squeaky wheel gets the grease.

But let's look at it. Does he have 30k laying around somewhere that you can prove? like a bank account? Odds are, he doesn't have it. Or if he does have it, it is illegal money that you can't prove exists.

Bottom line, you're not going to get it. You can let this tear your life apart. I have seen it happen. I have seen women turn into bitter monsters over this kind of thing. Or you can let it go. Let the state get what it can for you and your kids and move on with your life.

If you need financial assistance, talk to the enforcement agent and get the help your family needs.

Sadly, a deadbeat is a deadbeat.

I have a court in effect for over $40,000 on my X Hubby. : )
I hate deadbeats. Were you ever on Welfare? If so, call them and they will get it for you and they will tell you how to go about it. If not, Call within your City, an attorney who will take your case for either what they get for you (A percentage will come out of it), OR Try LEAGL AID Society in your town. I know we have one and So should other towns. Call your Government and ask for the Number.
By the way, My X is paying now,going on 2 years straight, after not paying before that for over 15 years. Patients is a vertue too. : ) I had lots of it. Then when My X went to try to buy a vehicle the state stepped in and cauaght him. SOME states donot allow them to buy anything IF they owe child support. My X is one of the sorriest so-called men you will ever run into. He hasn't been involved with his son since his son was age 1. He is now age 27.

Call your brother, uncle, nephew, or just the nice burley guy down the street. Explain your whole situation, and give him the deadbeat's address. Make sure you give him specific instructions not to hurt him (the deadbeat), just scare the hell out of him. It's also best for the "discussion" to happen on public property (like a park), not at the deadbeat's house. If your mole (uncle, nephew, brother, burley guy) is large and scary enough, he won't have to threaten him. He will just have to talk to him about "taking responsibility", and "being a man". It also helps if your mole dresses like a harley davidson biker, and doesn't hide the fact that he has brass knuckles "ready to go". ***Evil grin***

Your checks should start coming on a regular basis.

The "squeaky wheel gets greased". Call the Child Support agency weekly. Many States get drivers licenses suspended for non-payment. If your child is on a government program such as Florida Kids (States have different names for their coverage) they will also push the courts. You can check your local Courthose for forms also.

Yes. Subpoena is the key word. Subpoena information on his bank accounts (if you know where he banks). Once you find out if he has any money in these accounts, you can attach a writ to his accounts and get the money that way. DOes he work? Do they garnish his wages? They should be deducting his monthly payment plus a percentage of his arrearages.
Arrearages are judgments.

Go to your town's D.H.H.R. ask to speak to child advocate it dose not cost anything. these people will garnish wages right out of his paycheck. you just need to notify them of where he works. if he dose not work child advocate cant garnish wages from nothing,still apply with child advocate first. then go to your county court house and ask to fill out a modification for child support. they will set up you an hearing in the family law masters, a child advocate lawyer will show up on your behalf for no fee. they will then get him yo start paying payments, and if he don't they will put a ca-phis on him for his arrest and he will go to jail until he pays what the court orders him to pay which is usually $1'000 and this amount will come to you as child support. it is your job how ever to go to court each time a payment is late and file contemp on the modifcation for child support. then they will set up a hearing bring you and him back to court with your child advocate laywer present and he will be ask in court if he can make a payment at this hearing if not he will go back to jail and may be ask to pay the $1'000 or more be for he can get out of jail which will then be your's for support. remember the state can only help you if you file contempt on the modification for child support ever time he's late on a payment. it sound's like alot of agervation but after the dead beat go to jail 1 or 2 times he will get a job and keep up on his payments. beleive me it work's I have a dead beat mother who never paid me support and now she's never late on a payment. tou are the boss the reason state agencie's have not been aggressive is that you have not been aggressive this was also my problem. talk to chils advocate go to the court house and take charge yourself stste agencie's can not do it with out you I finaly found this out myself so be the boss. no luck needed if you take these step's don't delay your only hurting your self. I found it was more agervating not receiving my support. than going through child advocate and the court

are you their adopted father? If so, then yes you do. If not then the actual father's have to pay child support for her assistance of food stamps, medicaid and section 8.

first off why it gotta be deadbeat dads my ex-wife owes me more than that what about that state agency's do suck are you getting his tax returns can you get a lawyer to do it pro bono
