My soon to be ex-husband had his weekend with the kids this weekend. I told him that I needed to have the kids back by 3pm today. He has told me that he will not give them back to me and that they are going to live over there with him, his gf and her husband. The 3 adults all sleep in the same bed and my 7yo knows all about it. I am worried about my kids being over there in that type of situation. We all live on an Army Base in the US. Nothing is written on paper to the visitation agreements. Is there anything I can do if he doesn't bring them home at 3pm? PLEASE HELP!!!!

Let me elaborate on his living arrangements...he sleeps with the gf and her husband every night. My daughter knows of this and hears the 3 of them have sex. I have contacted his NCO and I am to call him if the kids are not returned at 3pm. I am supposed to have them tomorrow night just for the afternoon and dinner...he wants them to live in her house which is not their registered address and not only will they get in trouble for living there, but I can get in trouble cause he is living there. I will be moving to Cali to be with my family very soon.

Call his NCO..if anything the NCO should be able to help you out in this situation. Does the NCO know the situation with the gf and the husband?? Thats really uncalled for and if the NCO can't do anything best bet is to call the MP's. No kids should be put in that situation and have to listen to whats going on behind closed doors..if your 7yo can tell the MP's what she hears, he can go to jail along with the gf and her husband..call NCO now!! or the mps!!

Unfortunately if there is nothing on paper, he can keep them legally until there is... but by him being in a "threesome like" situation, which i think is unhealthy for the kids, this gives you the upper hand.... you have to get those kids back, get some evidence of this lifestyle your ex is living to present to a lawyer... If I were you, and I got my kids back, it would be a cold day in hell before they went back.... the police will not interfere without legal paper "signed" by a judge.... They will tell you it is a "Civil Matter". Who ever has the kids before you go to court, will be the person that gets them in the end....GET YOUR KIDS BACK, STAND YOUR GROUND, TALK TO A JUDGE.... YOU WILL WIN... GOOD LUCK

First off the Police can only enforce, not write laws or court orders. The DA has nothing to do with civil cases. You should have a lawyer by now and if the children are not returned you need to get hold of him first thing in the morning. It is not a good thing to use children as "pawns" in a divorce. It leaves them scared and hateful toward both parents.

Since there is no legal papers spelling any of this out, theres little legally you can do. You need to petition the courts for an immediate temporary child custody order til the divorce proceedings in which chances are you will be awarded full custody of them unless the courts rule you unfit. So for now til you can get that custody order,the kids can stay where they are. Sorry for my answer but these things occur everyday, good luck

Probably the only thing you can do, since you do not have anything written down on paper is call child services. It is not a safe nor healthy environment that your "ex-2-be" is providing for them, so they will probably take the children out of his care and give them back to you.

It is a wise idea to definitley get some kind of written visitation agreement, so you are not put in this situation again.

If worse comes to worse, call the cops. My mom did it once to get my brother back. You are just going to have to prove that your children are not in your "exes" best interest and you are the soul provider.

Honey, call the police and tell them what is going on. You should have an arrangement on paper by the court to say what days is agreed that he have the child followed by pick up and drop off times...That is VERY important and am suprised that the court made no suggestion to this and for your 7 year old child to be in such an enviroment, the court would never go for what your ex is doing

If this guy is in the military than go see his C.O or Base legal for help. This is a dominance deal. You need to go the high road and get this on paper so you don't lose sleep. The Army will make it right, believe me as a former Naval Officer I promise you they will listen. Good luck.

Get an attorney and a court ordered visitation agreement.

You can try to contact family services and see if they can do something. They should know all the legal stuff and be able to help you. Let them know his current living conditions and I'm sure they'll do what they can. The 3 PM thing may not be doable, but you should at least be able to get them back.

Legally no but I would go to the nearest courthouse as early as possible tomarrow and get a pende lite. Which is temporary custody until final judement is made. Explain on your request your concerns. They will then have it documented who has teh kids when and if they are violated then the violater will be held with contempt of court.
