I am asking this on the behalf of my friend because she and i disagree, 5 years ago when we started work at a local hospital, (we dont work with patient or even in the actual hospital dont worry shes not cutting people open or anything.. ) we did our drugtesting, well since then she has started smoking pot on occasion, i told her to be careful in case work does drugtest, she says that as long as she is not coming into work drunk and or stoned and does her job , unless they have probable cause they cannot randomly drug test you, its agianst your rights.. is this true? I think they can whenever for whatever reason, and how can i find the answer.. any one can offer the correct answer? we bet 20 bucks!

I'm not sure about all states, but in most, they have the right to do it. Companies that do will have a drug test policy in writing, I suggest checking with your HR department to find out what the policy is on random drug testing. The compnay would issue a polciy on it before strting such tests if they dont have one in place already.

Companies all do reserve the right to drugtest you. Infact, if you test positive for anything on a drug test, they have the right to fire you on the spot.

For example, many people have been fired over testing positive for opium. But they were eating poppy-seed bagels. They didn't get to talk to anyone about, and were fired on the spot.

So, to answer your question fully, you test positive for drugs, you face a high chance on being fired on the spot.

Random drug tests are legal and are done at the discretion of the company. This should be included in the handbook most companies issue, and have you sign, when you are accepted for employment. A companies insurance company is one of the reasons for doing this.

Yes companies can random drug teat employees. There is no need for probable cause in random testing. It is not a violation of her rights either because the terms of employment probably include employees to be drug free.

They do not have to have probable cause to do a randon drug screen. You should have signed a packet of papers when you were hired that informed you of the 'Drug Free' policy's and in those pages were probobly the clause that makes it OK for them to do random.

My place of employment is drug free and they pull people all the time, atleast 10 per week!
