Can I use copyrighted material for nonprofit purposes?

For example:

Lets say I were to make a game where i used Super Mario as the main character. Is it legal for me to put this up on my website for download? I would not be making profit in anyway.

Not without permission - unauthorized use is unauthorized use, regardless of profit.

You have to get permission first or they can still sue you. I would get it in writing.
