By law, depending on the size of your company (in terms of how many employees) he may have to offer Family Medical Leave, which is up to 12 weeks of UNPAID leave.

Employers mandated to follow this are ones who employ 50 or more employees for each working day during each of 20 or more calendar workweeks in the current or preceding calendar year.

There's more to that, which you can see on my link, but that's the gist.

It is spelled out in the Family Medical Leave Act.

If your employee doesn't offer vacation or sick pay, then your only option is unpaid leave. If your employer has fewer than 50 employees, then you will have to quit your job and try and get rehired when you decide to return.

Diann C is confused. They don't realize that the leave is based on the size of the company. Again, if your company is fewer than 50 people, your employer is NOT legally obligated to give you leave. That's not to say they can't choose to if you talk to them about it, but they are not bound by law.

If you live in the US, no there is no standard requirement for maternity leave. Maternity leave, paid and unpaid varies by company. If you have paid vacation time, you may need to use that.

edit: see your first poster for a link and explanation of the Family Medical Leave Act

By law he has to give you unpaid leave, not paid leave.
