You have federal right for time off "BUT" employer doesn't have pay you and when ready to return he has to have spot for you!doesn't have too have your old job but isn't supposed to effect your pay grade other wise take k=him to labor board and sue for back wages and job back at that time you can have an agreement written against firing for that reason!

If your boss doesn't offer it, you can still take off for FMLA as long as you have worked for the company at least a year. A birth is considered a valid reason. Plus the upside is that you won't lose your job. But if you can do some of the work from why don't you bring that suggestion to the table?
By the way if he doesn't give you what is legally your right (up to 12 weeks unpaid) be sure to remind him your rights and he consequence with the law if he doesn't follow it.

I'd go to Human Resources or Labor Dept...Maybe check State laws. I mean I have never heard of an employer not offering Maternity Leave! I thought they had to have it regardless due to discrimination laws, they just have a choice of paid or unpaid. Congrats though!!

I don't know i'am in the same situation as you,the bad thing about mine I was here before and quite and now back,when I was at my job before I had my first child they gave me 30 days unpaid, b.c. I hadn't been there for a year,and now they won't give me a leave at all,and I don't know what to do either,it just doesn't sound right,especially it makes me mad when I work so hard and never is late or absent unless I have to go to the doctor,hopefully we will find a resolution,good luck!

maternity leave is required by law. unless you work under-the table or for a company who is exempt fom these laws. i think the norm is 60 days and some even allow up to 120 days like mine did. but it is your employer's choice wether or not to pay you for it.
