i have an attorney that i retained for a misdemeanor case. i had a pre-trial conference scheduled, in which i was told that i did not need to attend. i hadnt heard any call back from him since that date (about 2 weeks ago), and I just did an online search of my court case tonight and found out that I have a warrant for failure to appear for that pre-trial conference!!! What should I do? I just left a message for my lawyer with what the hell just happened!!

Go to the courthouse first thing Monday morning and explain your situation to the clerk. Ask if the warrant can be recalled and a new court date scheduled.

Even if the warrant can't be recalled, you'll likely be issued a citation by a police officer with a new court date to appear.

It's highly unlikely that you'd be arrested, booked and transported to jail over a first time failure to appear...

Be pissed off at your attourney but don't sweat what happened too much...

You should not pay your attorney but must file a case against him for failure on the job in protecting you as a client. Then file an action to prohibit the service of the warrant since the failure to appear was not your fault but because of your irresponsible attorney.
