I quit a job with a large company 2 months ago. They have continued to direct deposit paychecks into my account. I am certain that this is not severance pay, vacation pay or anything like that - I only worked there a month. I was an hourly employee. I have not found another job as expected and I have used the money to live on. I may have signed something saying that they could reverse direct deposits that were incorrect, but I am not sure. I closed the checking account they were depositing the money into and my bank started putting it in my savings account. I don't want to contact them - because I dont have the money right now to give back to them. Other than request the money back, is there anything they can do? I know they can attempt to withdraw the money (its not there), but is there anything else?

I was hoping someone with some helpful information would reply - but just people making judgments. I was in a real bind when this happened and would have taken a different course of action under other circumstances. Does anyone know what legal course of action they have and if they are likely to take it?

Report the overpayments to your previous employer so that the deposits will be stopped. It will be very had to receive and waste the money because if the owner discover there case, the court will file a collection case against you..

If you do not contact them they will find out and may just withdraw it from your account wether the money is there or not....

This will mean your account will be overdrawn and your bank will contact you imediatly asking for the money...

I would call them and let them know you were unawear untill recently, that the money has been spent, and see if you can work out some terms where they withdraw a small ammount from you bank account each week or fortnight untill it is replayed. The longer you leave this issue the worse is can be...

Big Companies are usually not good at payroll management.

When they find out and you can't pay back, they will probably flip it to a collection agency who will threaten you with the police etc.

You might want to try closing out all of your accounts at that bank and go elsewhere. Who knows, you might get lucky.

It's not your money and you know it. Call them. They'll find out anyway then you'll be mandated by a judgement to pay it back. By closing the account, you may also be fingering yourself for fraud which would make it a criminal case.

You should have contacted them the first time you realized they were still paying you. I don't know what the process is but they will recover their money. Shame on you for not reporting it. I hope you loose sleep over it. Where are your morals?
