I had a friend who left cuba and stayed in Spain and then came over to the US , so that is ilegal , before the 5 years he tried to apply for a new cuban passport and the visa to visit his eldery mother, and he was denied , then he became a US citizen and more than 5 years had passed and he was allowed. I really think is a way to punish you for leaving ilegally but then again is my opinion, I had no troubles going there to visit as I won a visa lottery. For the US government is once every 3 years . even from the date you arrived for the first time

If you are referring to any rules of the Cuban government, that will be based on the date you left. Many Cubans who leave illegally are allowed to return to visit their families etc. (and bring cash !) I think the Cuban government may have relaxed the rules recently.

I think the US rules are three years from the date you leave. They are there as a thank you to the hardliners in Florida for electing Bush.

Are you a balsero ? You still have the Cuban nationality, when you left the country illegal and will be treated the same like other Cubans.
When you go back to Cuba you probaly will get a punishment for leaving the country illegal.
