Can anyone tell me what is the penalty for driving without insurance in Illinois and getting into an accident. I was driving my friend's car and got into an accident, it was my fault because i was changing lanes. I have already paid the other guy for his damages and have gotten a release from him. This is a first time offense, what will happen to me.

What if it is not me who owns the car. It's my friend's car and he's putting it away for the winter. I was driving it to the storage area when i got into the accident.

The fine could be $500 without insurance, and you will still be forced to obtain SR22 insurance. Get the insurance on your own, so the fine will be less.

That might help guide your decision on whether or not the offer is reasonable. Remember, there is never enough money to compensate for this kind of loss. The person at fault is the person who caused the death; the insurance company is just responsible to cover him up to the limits of the policy involved. In other words, if all the coverage available was $300K than that is all the insurance company would be obligated to pay in most circumstances if their insured (the at-fault party) was found liable in court up to that extent. This means, if you took the case to trial, got a $1M verdict from a jury; the insurance pays $300K and you have $600K to try and collect from the at-fault party. Bankruptcy would likely follow by this person and collecting nothing is probable. These are never easy cases, life isn't perfect, but just remember, most other countries in this world don't have insurance to even cover these losses. Sorry for the loss and good luck.

According to the Illinois Secretary of State's website, your license plates will be suspended, and you will be fined at least $500. There is also a $100 fee to re-instate your license plates. In addition, it will cost you MORE to purchase insurance than you would otherwise pay.

Contrary to other answers, it is up to the judge... within guidelines. A judge actually has the option of giving you jail time and suspending your license. Most of the time, if you show proof of insurance when you go to court it is lowered to a fine and 2 years probation. (unsupervised)
