Either they have not made a decision at this point or the prosecutor does not believe he/she can get a conviction.
When they called you back, they needed to flesh out more of the facts (probably because the prosecutor asked them to ask you about the missing facts).
They called you back to talk to the "rapist" because without his admission to a crime, it is unlikely they can get a conviction.
My guess is your complaint fits into the "he said/she said" type of rape with little other tangible evidence to overcome the beyond a reasonable doubt standard. Chances are he either invoked/got a lawyer or said it was consensual.
The fact that you actually had a phone call with the alleged rapists suggest to me (and the cops) that this was a "he said/she said" case or "date rape" case.
Having prosecuted and defended rape cases...they are tough to take to trial. Your entire life is paraded into the court-room. A defense attorney will pick at your story apart looking for holes. At the end of the day, people don't want to wrongly convict someone for rape, so prosecutors don't want to waste time, energy, resources on a hard-to-win case.
Check back with them. See if you can talk to the prosecutor involved with the case.

I all say they just don't believe you enough to make a case most if you didn't give them any prove of the rape. And I will tell you if the guy that had done the rape was your boyfriend or so. So they maybe believe him then you. Sometimes they don't care as much when cases like this.

Basically, they're looking for proof. I know that rape is a horrible thing to have happen, and I don't mean to discount what happened to you at all. But you need to realize that, just like any other crime, you have to be able to prove it. If you were alone with him, that makes it very difficult to prove, because it is your word against his. If it can't be proven, they can't really do very much to him.

When their investigation is complete, they will do one of two things. If they have enough evidence, they can arrest him. If they want a legal opinion on the evidence, they will forward it to the District Attorney for review and charges.
I would first call the PD and see if it has been forwarded. If it has, call the District Attorney on Monday morning.

Probably because they are still investigating and trying to build a good case so it will not be dismissed by the judge for lack of evidence.

Sounds like you have some incompetent law enforcement. Get in touch with the highest-up supervisor you can get in touch with and explain the situation. There is no excuse for how they're behaving. If they're still of no help, try getting help from the state-level police officers, not city level.

did you go to the hospital to get a rape kit test done? if not they may have nothing else to go on other than that test.and if you cant get the guy to confess and you have no witnesses then they may consider the case closed since its basically your word against his. without a rape kit done its almost impossible to convict someone of rape. call them and ask them what is going on

It will take the court system awhile to decide but remember along with murder there is no statue of limitions to be charged. This stands for life if they get the proof.

You have to be proactive about seeking the answer. Go to the police station to ask what happened? If nothing happens, seek a lawyer to get the ball rolling.
