Well now she has been adopted by her step father and has changed her last name. He wants to know since that has happened does he still have to pay current child support. I have no clue and it's none of my business, I just told him I would see if I could find out. I'll check with the child support agency asap but I thought maybe one of you might know.

Thanks!

I pretty much know how this works:
You say she was adopted by the step dad... are you SUre about this? I Mean.... did your fiance actually sign papers giving up his rights?? Just because she has a new last name..doesn't mean he was adopted ( I know this..because I changed my childs last name when he was younger ..but, i did not have the stepdad adopt him).......
so, if it is just a name change..he is not adopted..and then yes, he would continue to pay.

If your fiancee actually signed the papers..giving up his rights--and they were filed--etc...and he has proof of this....then NO< he would know longer have to pay child support..

BUT, if he owes money from before - (arrears) - for child support (he was behind on child support) then , that money would have to be paid back still....unless your fiancee and his ex agreed otherwise, and there is documentation on this.
So- i would say....... go up to the C.S office ASAP ..and check it out...

As for the girls comments above... are you on drugs...
can definately see the girl has issues she needs to deal with...
some people...

That depends upon the states they all live in. In some states as soon as he signs away all parental rights he is no longer libale for child support. In other states even if the child is adopted by someone else he is liable for child support...What does his court papers say regarding custody/support...HE should have READ them.

It depends on the state but I believe that he would still have to pay. See one example of a ruling in MA:

443 Mass. 494, 822 NE2d 714 (Feb. 17, 2005). Supreme Judicial Court held: "We conclude that a parent's consent to adoption of his or her child under G.L. c. 210, § 2, does not terminate the parental duty to support the child."

I guess he doesn't want to continue supporting her? Otherwise, why would he allow her to be adopted by another man?

He should check with his lawyer.

I also would wonder about marrying a guy who agrees to give up fatherhood of his biological child?

No. Since she has been adopted by her stepfather he is no financially responsible. It sounds to me like the ex is looking to use your fiance as a check book while she denies him any rights. You need to get w/ child support enforcement in your state immediately and demand that they stop your finaces payments.

If she has been adopted by another man...that means her father had to give up his rights...He will no longer have to pay child support for this daughter...because another man has assumed position as her father....

I think if she was LEGALLY adopted, he is no longer financially liable. But definitely check with the agency.

if the stepfather legally adopts the child, then your fiance would have had to give up his parental rights. did he go to court and agree to this? sounds like he didn't otherwise he would have known. once his parental rights are stripped, he has nothing to do with the child financially or emotionally. child support office has nothing to do with this. you havet o go to family court as this is a custody matter. once this matter is resolved, then child support services will close the child support case as long as he is up to date on hisp ayments.

No, if this child has been legally adopted by another male, your fiance is very lucky. Now then, please, practice safe, responsible, non reproductive sex until you are married.
