lydia,an adult was intoxicated when horton allowed lydia to borrow his car. lydia lost control of the car,crashed,and was rendered a quadriplegic.lydia sued horton for first-party negligent entrustment,claiming that horton shouldhave recognized that lydia was too drunk to be entrusted with the car

Wow...that's a sticky situation!! Although Horton should have recognized that Lydia was drunk, she may not have shown clear signs of being too intoxicated to drive. She was the driver of the car, she chose to get into said vehicle...I think she is more negligent than he is. We could also take this one step further and say that the one who was giving Lydia all that alcohol is responsible. Bottom line, I feel that people need to take responsibility for one's own actions. She would be responsible if she had hit something or worse someone...so why wouldn't she be responsible for her own injuries??

This is a hypothetical, I suppose, situation that is becoming an increasing hallmark of today's society.
What happened to personal responsibility?
A lot of people talk a good game about personal responsibility but, more and more, it is becoming commonplace for everyone to look for loopholes.
OK...Think about your question. It all boils down to nomenclature. Does it not?
How about wording it this way.
"lydia,an adult was intoxicated when she took advantage of horton, who was also intoxicated, and borrowed his car."

Bottom line.
Don't drive drunk!

I think Lydia is busted. She should have known better than to drive drunk. Horton may not have known that she was as drunk as she was because some people seem to be able to hide it well.

No, he's not responsible for the actions of another adult ... unless of course she was falling down drunk and sluring her words ... then he could have a problem .....

She is responsible for her own actions .....

It's really not about who did what... it's the "Deep Pockets" thing .....sue all you can to get as much cash as you can.

Rule ... Never let anyone burrow any thing.

all horton has to say is that she wasnt intoxicated when he allowed her to borrow it. his word against hers..the drunk driver.
