She was 15 and I was 19. She was willing and sober while I was drunk and diden't check her I.D.

The judge doesn't "accuse" anybody. The prosecutor does that. The judge may find you guilty. The judge has immunity from lawsuits, so you can't sue him. From the facts you present, you did commit satutory rape unless you reasonably believed she was older. I guess the evidence on that point wasn't strong in your favor or you would probably have been acquitted. Why are you getting drunk at 19 in the company of younger girls? Can't you find any your own age, or better, who are old enough to drink themselves?

Well since you were drunk then you could say you were date raped since she was sober while you were drunk.

Today we live in a society that view women as the victims and men as the criminals. Double standards suck, I mean just look at the Duke Lacrosse case. The woman just got a slap on the wrist for falsely accusing rape but the guys reputation will be tarnished forever.

Date rape is when someone takes advantage of someone who is drunk or drugged.

I don't thinks its far that women get away with lies because we view them as weak and helpless.

Doesn't matter if she was willing, or even if she was the one that instigated it. If she was under the age of consent in your unnamed State, then it's illegal, and there was nothing "false" about the allegation.

Statutory rape is what's called a "crime of strict liability". That means that "I didn't know she was underage" isn't a legal defense. Nor is "I didn't check her ID" - in fact, even if you DID check her ID, and she had a fake one, it would STILL be statutory rape.

that would be right to do that but we have to follow these stupid fucken laws that even though she was willing and sober you still get accused. Statutory rape law is just stupid dumb and annoying

I am sorry but you are guilty and you cannot sue the judge. If what you wrote is factual then you are in for it.
