I kept mine on for about 2 months after the divorce was final due to problems in communication with my attorney and the insurance company, but they back dated the eligibility period to the date that the divorce was final and didn't pay for anything after that date.. I am unsure what they would do if they had already paid for something during the time after divorce but before they were notified.. it might be grounds for fraud... at the least I think he'd have to pay back for services charged during the time after divorce.. hey, here's an idea, call your insurance company and ask... (you could do it anonymously) or ask your attorney..

Yes it is legal and for however long one wants them on their insurance. A lot of courts will accomodate for two years. I'm currently battling MY ex to file the disillusionment of marriage with the military so I can be dropped from the insurance they provide because it sucks and once he files I will receive 1/3 his Air Force retirement and will be able to afford my OWN health benifits.

Insurance fraud. My ex & her mom got on my case many years ago because I took her off the insurance after her divorce from me became final.

They obviously did not care if I got put in jail for insurance fraud.
