Let's say you are applying for a job at a retail store. The retail store is hiring, and you present yourself fine to the store while applying for the job. Several weeks go by and they don't call you in for a job interview. Soon enough, you call the retail store's hiring manager for a follow up on your application. You are told by the hiring manager that you qualify for the job, but they don't want to interview you because you they don't like your physical appearence. Then they tell you that they also don't like the fact you are not the opposite sex/gender.

Would I need some type of evidence, to sue a reatil store for descrimination?

If they actually said that to you then yes you can sue and you should contact the EEOC , better business bureau and the attorney general in your area to find out more information

Need more information...
Are you a male looking for a job (on the floor)at "Victoria Secret"? The bottomline..."it all depends". In some cases sex/gender considerations are not discriminatory.

Retailers know their target market...IF, you have spikey green hair, tatoos and and piercings...they may have policy that applies to all applicants...if you don't fit the policy...they are not discriminating against you specifically.

They are not obigated to interview ALL applicants...they can screen applications till they come up with a few they will pick from and stop at that point. Lower level retail jobs are not subjected to the precision you are demanding.

If you were applying for a six figure a year government job...they really have some stringent hiring practices.

The truth of the matter...if anyone doesn't want to hire you...they will and can find a legal and suitable way not to...(if they have any savy at all). If they feel that way...you don't want to work for them...you will only have trouble. It would be a bad marriage.

Step back and take an honest look at yourself. The appearance thing is age-old. You might feel angry for being rejected but, they are entitled to hire who they want to project the image they want. Go see a job counselor and ask for an honest opinion...this might be an opportunity for growth or....it just might be their loss.

That is my honest and best answer!

I find it very very hard to believe that a statement like that was ever made by anyone in Human Resources with at least 2 fingers of sloping forehead!

Nevertheless ... if you have a corroborating witness, you have a case, no witness, no nothing, so ... move on and consider a new deodorant and some Plastic surgery before the next interview.?

The definition of "present yourself fine" is very subjective. In my opinion, unless you wore a suit and tie, you were under dressed for the interview.

If you get enough bad press for the store you dont need anything. They dont want look bad and may settle, then your golden
