if both teams are 10-2 with the same conference recird and have never played each other who gets by??

Depends on the conference. Each conference has their own set of tiebreakers (the only major conference that could happen in now would be the Big Ten, as the Pac Ten and Big East have full round-robin schedules and the other three conferences have title games where everyone plays everyone else in their division).
