I'm not legally seprated from my husband. He just told me that he's moving back to Ga. in a one bedroom apartment and he wants to get our 15 month daughter for a couple of months. He works at night and I'm worried that he might run. What can I do? Can he actually take her? I'm not working but I've got a place to live and food for us to eat. He helps buy her stuff though.

If you are scared that he might run with her then you need to go to court and put in a petition for custody. Since she is so young the Judge will not hestite on giving you either full or particle custody. Yes, He can take her. If there is no order of Custody then he has the right as the father to his daughter. However, I would go court to get custody. You rather be safe then sorry later.

NOT a good idea to let her go for so long. She's only 15 months old, for crying out loud!! She should not be away from you for "a couple of months". If you don't already have one, get an attorney NOW and get some paperwork filed asking for full custody. You need to get something on record with the court so you will have some rights if he runs. As it stands, he has just as much right as you do.

No until your have a court order child custody order, both parents have joint custody of the child. In most cases, courts discourage parents from leaving the state with the child until there is an order.

You better take a stand and keep him from taking the baby away. And anyway a 15 mth old baby should be with her mother in the first place. Good Luck

If you are not living together but proceeding with a divorce then get an attorney now. Check with your attorney on the legal issues. You need to be declared the custodial parent to prevent him taking her. At that age I wouldn't give permission for an extended absence unless the circumstances were very unusual. You are right to be wary if he threatens to take the child to another state. They can disappear and it can be very hard to locate them, if not impossible. Until you have a court decision don't leave him alone with the child.

You need a lawyer fast...you have nothing legal going on for you now..you need to so you can have your say. Get to Family Court...get the paper work started...protect your daughter.

I don't know about your state, but in Georgia, unless you are married you have full custody.

I am not married to my partner and we have a six year old daughter. According to three lawyers here, until he takes me to court to gain joint custody, he has no custody rights. And yes he is on the birth certificate and she has his last name.

Tell him the hell he will!!! Get a court order ASAP that will stop him from doing this.

And are you seriously thinking about letting your ex take YOUR baby with him???... She's a BABY... she needs you more than ever. I wouldn't do that.
