now that my wife's estate is being settled, her twin says she should get half of my sister's estate because they were twins. Could this be true?

Hmm... I only think it could be true if she wrote her twin sister into her will. I dont beleive their is a law that says 'If a twin passes away, their other half will recieve their goods and property" or anything. I mean, what if they had a twin, but were adopted into different families. But anyway, I would find out if your wife had a will ( I would imagine you would know that if you were married to her, right?) and left her sister as being in charge of the estate after she died. I think that is the only way she could have legal access to anything. Otherwise I would believe it would go to you, being the husband. I am sorry for your loss and good luck.

Sorry to hear about your wife, but her twin sister has no legal right to half your estate you married her sister NOT HER! so who is she to say she wants half of everything? thats beyond crazy, and how can she even be worried about money at a time like this??

But never the less make sure theres nothing in your wife's will about her estate being given to her twin if shes written one...God bless

Your wife's twin is worrying you unnecessarily. Since you were the spouse, you are declared first of kin and will inherit her estate unless there was a will.

Turn the tables on your wife's twin if she wants to play this game. Remind her that she shares the DNA of you wife and may end up with uterine cancer as well.

NOT AT ALL! As her husband you are her closest beneficiary. Unless your wife specifically left something to her sister in her will, then you have no obligation to the twin sister. I think it is rotten when someone dies and family/friends think they are entitled to anything. When someone dies you're supposed to accept what was left for you graciously and be grateful for it. I would suggest finding something of your wifes and giving it to her sister just out of the kindness of your heart. DO NOT let her bully you into half. You were your wife's partner and just because she had a twin does not make your bond mean any less. Your bond with your wife, legally, is stronger with regards to who gets her estate and how much. Your sister in law could try to fight it but she will lose. It's insanity for her to think she is entitled to half just because they were twins. I'm so sorry for your loss and the added stress you have to endure because of anyone elses expectations or demands.

Not true unless your departed wife left a will naming her as 50% owner of the estate... When no will is found, husband gets 100%

No. The twin is just another sibling, unless your wife added the twin to her will, or there is another legally binding familial issue. See a lawyer to sort this out. I'm sorry for your loss.

Her being a twin is so no different than being a "sibling". She most definitely is not going to get half of anything, unless your wife actually left it to her in her will.

No, that is not true. Did your wife have a Will? Even if she didn't you were married so, her estate should go to you and your children (if you have any).

If you were married it is yours. The only way her twin could get half is if she had a will that stated so

No.....period..... so sorry for your loss...been there done that too... unless you wife had a will that stated she wanted to leave that much to her sister there is no way she should get anything.

Most states if there is no will will leave all to the surviving spouse
unless there are children and then they have a split between the spouse and the kids.... all other relatives are SOL unless there is a will that includes provisions for them.
