one of which cannot be found despite reasonable efforts to find them. how will the estate be devided? Can the executor of the will decide to put the fourth share in the bank , in case he eventually turns up? Or must the estate be devided among the three children who can be found. There is no wife in this scenario. Thanks

The efforts had better be pretty thorough to find the missing heir. The court does not like to cut someone out mistakenly. Usually, if reasonable steps are taken to no avail, then the remaining 3 will divide the estate equally (in most states).

you said there is no will, so thus no executor. in this case i would hazard a guess the money is divided between the 3 children and it is up to them to put money aside for the 4th. trick question.

the law decides, it goe`s to what they call probate.
look it up through google. and it will give you the relative info.
