I purchased a hot beverage from a restaurant. After it cooled I was drinking it and found a piece of plastic tubing. The tube was about an inch in length and one end was cut at a slant. I was lucky not to cut my mouth, let alone swallow it. Do I have any recourse here or would I be wasting my time? I have contacted their main office, but have not heard from them yet.
Any advice is appreciated.

If you have not already told the restaurant manager about this, just let them know and they would be more careful about this kind of stuff. Also, try to be in their shoe for some time and think what you would like the customer to do. If I were them I would want the customer to let me know about any such mistakes and would make sure that things like that do not happen again. Despite thorough check sometimes things like this happen. It is important how we handle these things and make life easy for us and others.

Very unprofessional. You should have put the plastic in the side of your gum, taken a drink right on line, faked a seizure, have a friend Heimlich you, hammer the counter with your hand, then finally spit it out on the counter for everyone to see. At that point, you could wheeze for a minute while holding your throat. A few coughs and hacks should do it. Happy days are here again.

That's why our insurance rates are so high. You admitted yourself that nothing happened to you. Yes, they made a mistake but what do you think you deserve from finding a piece of plastic in your drink?

Maybe you'll get a free drink, if you're lucky. Sorry!

Stop wasting your time. You were not hurt, you are fine, and you are just looking for money. Hopefully you told the manager at the time it happened. Any reputable business person would want to remedy the problem and make sure it doesn't happen again.

As long as you were not injured and don't have any medical expenses, you don't have a case. The restaurant may give you a coupon or a free drink.

You can call the department of health, or the licensing agency that allows them to operate and file a complaint. As far as a lawsuit it will be hard, because you did not incur any damages.

i hate people like this. why does everyone have to make a lawsuit for nothing? it was a mistake, go and get your money back and be done with it. why would you even feel the need to sue?

did you let the manager know about it????? right as it happend??? if you did get a laywer and go for the money..
if you didnt nothing will come of it.... good luck
