l have two kids one is 2yrs old and the other is newborn. when my husband got back from iraq he was medically discharged and we were forced to come back home. we entered the shelter system but they found us ineligible. my mother says she can turn over the voucher to my name and we can stay in the apartment and continue paying the rent. my question is, is this possible and is it legal

No it is not. The vouchers are tax dollars and fairly regulated. They can not be sold, traded, or transfered.

It's not legal. The voucher is for your mother, not for you and your husband. Should the housing authority ever discover your deceit, both you AND your mother could face welfare fraud charges.

your county or other government unit handles section 8 housing assistance. I believe there is a link at hud.gov which will help you find the local office.

each tenant has to be approved for section 8, as well as the property. since I'm not clear from your description as to whether your mother is the section 8 tenant or landlord, please seek advice from your local government's counselor on this.
