I have tried to adjust the linkage but the lever stays in the up position (closed). I have also bought a new cotter pin to try to make the spring on the estucheon plate tighter. I'm very frustrated with what seems a simple problem.

I have tried extending the linkage in both directions and the lever still remains up. The long screw for the linkage also gets in the way of the washer from the back of the plate. Still confused!

This may not be obvious, but are you installing the plate correct edge up? I replaced the very old drain in a very old deep tube and wanted the drain slots on the top so the tub would fill further. I had to make several modifications.
I would say that staying up means something is jambing because in the several types I looked at, up was the relaxed position with the forced move being down.

since you give very little information we will play a guessing game. My guess is you are adjusting the linkage the wrong direction. To be able to push the lever down to make the tub drain the linkage has to be short enough to lift the stopper. Another reason it might not drain is the stopper is not connected to the linkage, (it has come apart).
