Because the upstairs floor is secured to a wooden frame, and it's the nails moving within the wood that makes the creaking noises. The downstairs floors are concrete.

Well it could either be your mind trying to make it all the more spooky because you do not know what could be happening upstairs, or because the upper floor is being supported by beams, and they are the things that creak because of the pressure on them.

It is quite strange,when I go to bed the whole house seems to creak and bang, you lay in bed and think "what the hell is that". my husband says it is the house settling down for the night, I just wish it would do it more quietly.
