If the court feel the child is old enough to make that choice and neither parent has anything to make them unsuitable for custody, then the child can make a choice but it is still up to the Court to make the final decision but a Judge will usually honor that choice.

I'm sorry to hear about your parents. Just remember the divorce has nothing to do with you! It is not your fault at all! You did nothing wrong! It's between your parents, something has happened between them. They both still love you very much! They will probably fight over you because neither of them want to loose you. They are both scared of loosing you too. They are both hurting for you and what your going through also.
But as to your question, it depends on your age and what the judge thinks is best for you.

Your choice is taken into account by the court if you are old enough to make a choice like that. Your parents should also discuss that with you and help you to consider the pros and cons if that is an issue. You shouldn't be made to feel like you are choosing sides.

Normally, if you are healthy and mature they will allow. I think the judge talks to most children no matter the age. You may want to get the name of the judge who will be handling the case and ask to talk to him/her. You may also talk to the lawyer of the parent you wish to live with and get that persons advice. If you ask to keep it confidential, it is their legal responsibility not to tell what you say you want. Keep the faith. The divorced is NOT your fault. There are social workers who deal with children in your situations. School social workers are truly or should truly know how to help you make it through this horrendous time.

In Pa, it was 13 yrs old you could choose. My parents split when I was 16 and I chose my father. then again 13 was the age 7 yrs ago, not sure if it's the same now or not.
