Long story, but I feel I should explain as much as I can so I can get the best help.
My husband abused me and through me out of the house. I got back on my feet and filed for divorce. The kids have been with him and he wont let me near them. No one has custody and he won't respond to the divorce so there is no court date. We both legally have rights to the kids but I can't see them. I have tried all I know to do, aside from letting him kill me for coming to see the kids. What can I do?

Find a good attorney, file for an emergency order for temporary custody, and pick them up from school after the judge signs the order. Then ask the police to accompany you to pick up your children's things.

You won't get anywhere until you have an attorney. His refusal to respond to the divorce is just one thing that an attorney will deal with. You cannot get any rights with your kids until there is a legal decision.

YOU need an attorney. OR wait till the kids go to school and take them with you.LEAVE the state. FILE 4 divorce in another state.

Your Lawyer has failed to give you the legal relief so change the lawyer and engage a good lawyer so that you should get an early and a better result.
