They should be happy the TV program may sell their CD's. Now they are doing a Metallica(Napster), even worse maybe, because it WAS Metallicas music, but NOT the Chili Wilies word!

Not only should they but the suit has already been filed. Showtime totally ripped off the RHCP.

I think it is crap-ola. This is just the Red Hot Chili Peppers being douchebags. It's not like the show is using their music, or that people would get the song confused with the show. They have money out the butt, plus the show has a terrible time slot and probably won't last long, so what's the deal?

The second I heard about the program, I thought that the Red Hot Chili Peppers had given them permission to use the name. It was not a name that I had heard of before they came out with the song. As far as I am concerned, that name belongs to the band. If Showtime made a show using that name and did not get permission from the band then Showtime is violating copyright laws. Maybe their legal department should have done a bit of research on the subject. To add fuel to the fire, there is a character on the show named Dani California which is the title of another Red Hot Chili Pepper song.

I don't think they will win because there is some evidence that the word had existed long before Red Hot Chili Peppers came out with the song. They're probably just trying their luck. :-/

Well, lots of things have to go into this. It's all about permissions and what happens in the show. If the show is using material from RHCP without their permission, then yes, that is illegal and the band can choose whether to sue or not.

However, for a rich band like them, they should not be suing people at all...tons of multi-platinum records, flea, grammy awards, etc. I don't know what bothers them. Now, if I was in a band and someone made references to my band, would I sue them.

No they haven't got a leg to stand on. It's already been proven that the name predates the album and not everyone equates the name with the programme.

I think artists need to pick their battles. At the end of the day the show won't last past three maybe (at a stretch) five series and then it will sink without a trace.

If they registered it and it is a brand name..... yes. If no... bad luck. I think no one can just say a thing and make it up and think he owns it. Let's say I make up a name for my kid...
DIVINACHERRIE and someone names a main character of a movie, book, tv series that way. How could I show I had it first without having patented it??
Anyway I think RHCP are rich enough and I hate persons who contest or fight anything.

No, they should not. I don't believe that they have exclusive rights to the word. That is like saying you can't use a word if I modified it first. Did they make up the word? Do they have proof they invented the word? Don't they have enough money yet. God knows Flea saves enough on his wardrobe by just wearing socks onstage.

yes, they are the greatest band ever and if the RHCP didn't give them permission then they have every right to sue them, especially after numerous references to the Chili Peppers.

I wouldn't bother personally, it seems like a lot of effort, but they definitely should if they can be bothered!
