Specifically, can we subpoena previous years tax returns, etc. to show that they are misleading the lawsuit or falsely claiming their real position?

Talk to your attorney. Do it now. Ask if you can force an injunction on them to stop their filing before you can complete the execution of your suit. Ask for full disclosure of their earnings.

Let them threaten--it may just be sword-rattling.

If they do file bankruptcy, there are a couple of options for you. You can object to their discharge based on the fraudulent statements they made. Or you can remove your lawsuit to Bankruptcy Court. Your lawsuit may qualify as a tortious judgment that is not affected by the bankruptcy.

No you can't only a judge can issue a subpoena, and then only if he has just cause to believe those documents are relevant to the case before him

you sure can do that, you have to talk to your lawyer and the judge to get that done. once its proven they are lieing they will be chraged with purjury.
