Myself (a tenant) and the tenants living/renting in my apartment building are all being listed in a lawsuit as defendants. The mortage co. is the suing party. Obviously their loan is not being paid off. How can they come after the tenants? makes no sense. We have no interest in the property other than renting apartments there. Any help would be so greatly appreciated. Not sure where to turn. I can't really afford to hire a lawyer, and don't qualify for free legal. THANKS.

They name the tenants so they can kick you out when they get the right to take possession of the property. You must appear in court. There's not really much you need a lawyer for. You should do a little internet research so you learn the procedure and what your remedies are. You can't stay forever, but you should know how long you can stay by learning the legal procedure.

They may be including all the tenants as 'interested parties'. Are you certain that you have read the summons correctly, in that they are suing for monies and not eviction ?

In either event, you MUST respond to the summons legally, or you can be found in default and have a judgment lodged against yourself, simply for lack of response.
