mediators are just like marriage counselors. There job is either to see if you marriage is salvageable and give you both counselling. Here your husband did not want to be counselled yet they had no choice other than return the report to court and leave it for the court to decide the next decision. If you want to continue with divorce, sure you will get. Gather all your relevant legal documents, documents of your assets, check out what your legal rights are, including those of legal interests to your daughter and file for divorce. You might have uncontested divorce at hand but if he challanges it, perhap you will have to get an attorney to assist you out.

Do you have a good family practice lawyer? If not, you need to get one. If your husband is not willing to work with a mediator, then your case will be scheduled to go before a judge, and that could take up to a year depending on how busy your court system is. If you obtain a lawyer, your lawyer should be able to attempt another reschedule of a mediator.

You need to talk to an attorney - go to legal aid if you can't afford one. your husband may come up with an excuse why he never went and have the court set another date for the counseling and use that as a way of postponing the divorce - and when he has to start paying child support. See an attorney and have one thee to protect your interests in court.
