I feel so powerless and afraid for my girls...please read and offer ANY advice. I have physical custody of my 3 daughters, and my ex filed a restraining order against me (it WAS GRANTED!!!). He's claimed(obviously untrue) I hit them/put them in dangerous situations/don't bathe them/among numerous other insane accusations. He began a custody battle 2 mos after the div was finalized 1 yr ago. I can't afford to hire a decent atty. He was abusive in the marriage, hasn't had much interest in them until the last year. He simply doesn't want to pay child support. I'm a stay at home soccer type mom who LIVES for her children. He won't even help with homework. His lies are better than my truths. No ones even interviewed the girls, and I haven't been ALLOWED to present ANY evidence to the judge!Tomorrow I won't know the next time I'll be allowed to speak to or see them. I'm dying inside!Advice, prayers, moral support!? PLEASE! I can't believe this is happening to us!

I am in the middle of something similar. I have been removed from my family. My wife and I did not want a divorce, my teenagers wanted to move out, to live with their mother, my ex-wife. She owes about 10 years worth of child support, minus the two times the IRS sent me her income tax return. Their mother called Children's Protective Services against me. I spent nearly six months in jail for things I would never do...the teens got their wish, and I am never allowed to see or communicate with them again. In July, the judge said I should be reunified with my current wife and younger children before the end of the year. The day before Thanksgiving, the CPS social worker told my wife that I may never go home again, and she wants to make it so that I don't get to see my youngest daughter (whom I have been able to see without interference) who was born while I was in the jail. Her reasoning is because it's not fair to the rest of the children to not be able to see me anytime like she can. She is trying to put doubts into my wife's head to get us to divorce each other. My wife knows me well enough to know the allegations are untrue. I even passed the polygraph test. Adults who try to tear peoples families up are EVIL, and will get their own reward on judgment day. The Foster Care system, along side the rest of the social welfare system is geared to make money no matter what happens. They don't care about the truth, nor do they care about the children involved...otherwise they would do real investigations before they destroy the homes of innocent children.
You must persevere and hang on to faith in God. Pray unceasingly. It's the only thing that has kept me going all this time (nearly two years). I will pray for you. Keep your chin up. Also, remember my family in your prayers, Dec.5 is our next hearing...the CPS social worker does not have my family's best interest on her agenda--she's looking for the monetary bonus and status of keeping a family separated, and possibly getting one of my kids put into the foster care system or adoption. I have four lovely children with my current wife--we send them to private Christian school. They are everything we have...my wife and I love them and each other more than any other humans on the planet and would never bring any harm to them.
I asked the CPS social worker why she quit teaching to become a social worker. She literally told me it was because she saw where the power was. My immediate thoughts were that she was a power hungry person....
Public defenders who work for family court are the puppets of the Children's Protective Services. They will not represent you to the best of their ability. In fact, they'll advise you to plead no contest and just do whatever the social workers say. Mine have admitted they don't like to step on the toes of their colleagues. They told me to hire someone from out of the county. The one I hired for a week or two asked for 10k up front which was to be followed up with another 12k...once we fired him, he started using the money and only gave back 7k. He was in cahoots with the public defenders that recommended him 'off the record'.

Do you have a lawyer? If not, now is the time to get one. You should be able to get a public attorney. Look up public services in your area. I wish I could offer you better advice, but I don't know much about this. In the meantime, make sure you have a support network set up. Family, friends, neighbors, religious communities... lean on them during this difficult time.

You have custody of your daugters but your ex filed a restraining order on behalf of your daughters?

Check for "Legal-Aid" in your phonebook. They offer legal advise on the phone and may represent you in court if you can't afford a lawyer. They are also online.
