After months of horrible, untrue allegations in a custody battle, my ex filed an emergency restraining order for me AGAINST my own children. The courts granted it!! I have not yet been allowed to present one shred of evidence to the judge... I'm terrified for my kids, as he doesn't even know the basics of child-rearing. After tomorrow, I have no idea when I'll be able to see or talk to them again. My lawyer is no help.....she hardly returns calls, completely unorganized, etc...My $5000 retainer has run out, I have no money left to hire new counsel. I can't believe this is happening! What kind of world do we live in when a man can leave his wife and children for another woman, legally assault and harrass his ex through the courts, and take the children when he's had no interest in them other than the past year? They are 7,5,and 3, I have been a stay at home mom since the day they were born. I was granted physical custody of them thru the divorce, he has weekends. What can I do?

Contact your State's Attorneys Office. They can provide you with information about the restraining order and your options. They may also be able to give you some options for affordable legal representation.
You will have to stay calm and in control, ask for at least supervised visits until this is settled and you will have to refrain from arguing with your ex in any way so he has no cause to stop you from seeing the children.
If they are not living with you for the time being, get a job to help pay for a new lawyer.

If you have no more $'s for a lawyer, get the law books & become your own lawyer. You do have a right to challange any of this in court, but you gotta know how
For now though it sound like your legal options are pretty limited.

Family Court can definitely be one-sided. Usually the side of the mother. I am curious as to what your ex said to the court for a grant him custody.

Don't suppose there is any such thing as legal aide lawyers in the States but that is what you need. Other than that I would ask your parents (anyone) to help you retain a better lawyer and fight this.

You are going to need a good attorney.

Try a local law school. They should have programs to help people like you.

And you will also need to take care of the unresolved problems in your own personal life. You know what I am talking about... the issue you did not mention.

Good luck.

There are organizations that offer free counsel and also go to the news media, they love stories like yours. You write a letter to the judge explaining everything and tell him to interview your children.
