If someone is selling marijuana out of someone elses house without them knowing they can lose there house because of the person that was selling drugs?I'm confused.

Yes. not just in Texas but in most States, the owner of a property used for drug trafficking can have the property forfeited.

There's an "innocent owner" defense, but it's up to the owner to prove they didn't know, and could not reasonably be expected to have known, about the illegal activity. Such defenses can be very expensive to mount.

Bottom line.... know who's in your house and what they're up to. If your kids smoke dope, they ARE putting your house at risk.

(And don't forget, if you have a mortgage and your house gets forfeited, you still owe the mortgage even though you don't own the house)
